Here is the discussion from the call: http://seekingalpha.com/article/149303-polaris-industries-inc-q2-20...

A comment from Bennett Morgan, President
We remain committed and excited about the Victory business. Next week we will announce key new models at our dealer show that will allow us to reach a broader motorcycle audience and segments with heavy weight cruisers and touring. We also announced recently the formation of our new on road division designed specifically to get more resources focused on our Victory business and other on road opportunities.

Also, Polaris has announced a new vechicle, the Breeze which sounds like a mini-car type vehicle for Master Planned communities, all electric. It has multiple uses, cost $7500.

From the article
"No doubt this is a challenging time in motorcycles, but facing up to the industry realities, getting more resources dedicated to the business and continuing to invest in new product, have us optimistic our Victory business will be stronger as a result in the long run.

Parts, garments and accessories – PGA sales declined 13% in the second quarter due primarily to lower retail sales in all product lines. Our PGA business continues to expand its gross margins impressively in a lower volume environment and as we expected, continues to outperform our overall Polaris business. Our focus on innovation continues and we will launch almost 200 new accessory products next week at our show."

Thanks VT. HD's report looked a lot grimmer....

......or perhaps PGA Sales are down in part because the Fly By Night t-shirt printers are diving headfirst into the trademark infringement waters by advertising and selling "Victory" branded merchadise on websites such as this one, thevog and ebay.

If Polaris were Disney these guys would have padlocks on their doors already and lawyers devouring their children's college funds.

I wonder though TP is that really a reason? I have a few Vic shirts but honestly they are dealer specfic with the Victory logo. I have one TM Vision shirt and that's it. Why? Well, I'll tell you why, my dealer never has any shirts that I like that are Polaris/Victory licensed, period. I like long sleeve T's and long sleeve shirts and 100% of the ones they stock are NOT my size. I bring this up to the "sales" person and the reply I get is "well, that is what they send us." Now, you can say "why don't you order some?" good question, but why don't they stock them, they'll sell like hot cakes, as I'm about the same size as many other 50 year old males that ride victory's and I've heard them complain as well.

Okay, so what does all that mean? I don't know, I screwed them over again by putting a supertech oil filter on, but I did use the Vic 20/40 semisynthetic oil, so that should count for something.

I'm not a lawyer, and it's been a long time since I sold my screen printing business; but I dont think that copywrite law has loosened up much in the intervening years.

I think its safe to say that since Victory and Vision are both trademarks; using them together on a t-shirt (no matter what the typestyle) and then attempting to sell them on motorcycle related sites is pretty strong evidence that you are trying to profit from the intellectual property owned by someone else.

I know its a down economy and some people think that its small potatoes that some cat with a embroidery machine is trying to make a few bucks. But being a legitimate business is tough enough without counterfeiters selling substandard goods with your name on them. Also there is a company that licenses Victory's name for garments that paid big bucks for the rights and pays royalties on sales.

Counterfeiters pay nothing to the legitimate owners of the trademarks, employ few, and pay no taxes. They are parasites.

Every major brand spends obscene amounts of money protecting their Name, their logos and trademarks because under the law they are required to. If they dont protect a trademark then they run the risk of loosing it.

Xerox and Kleenex spent millions trying to keep these names from becoming public domain.
