Fargo, ND | Murder charge filed in crash that killed marshal THE ASSOCIATED PRESS
SOUTH BEND, Ind. — A man whose SUV collided with a motorcycle ridden by an off-duty town marshal then intentionally drove over the fallen lawman, killing him, authorities said Monday.
Craig Toner, 49, the town marshal of Roseland, was riding his motorcycle with his brother in northern Indiana when the SUV crossed the center line about 3:20 p.m. Saturday and hit him head-on.
Witnesses told police that Toner told his brother, “I’m OK,” and lifted himself up on an elbow, only to be run over.
The driver of the SUV, Alexander Orta of South Bend, was charged Monday with murder, operating a motor vehicle under the influence, and leaving the scene after an accident resulting in death. Police said Orta had cocaine in his system and a portable breath test showed he had been drinking. Orta was being held without bond Monday in the St. Joseph County Jail.
According to a probable cause affidavit, witnesses told police that before the accident Orta was driving erratically and was weaving around cars. Witnesses also said that when Toner was hit, he rolled up onto the hood of the car, hit the windshield and dropped to the ground. Orta got out of his vehicle, saw Toner, and ran over him.
Witnesses said that before he was run over, Toner told Orta that he “wasn’t going anywhere, he had just hit a police officer.”
Orta was arrested after crashing the SUV into a fence and some trees about a half mile away.
According to South Bend television station WSBT, Orta has been arrested 19 times since 2000 for offenses including theft, criminal mischief, public intoxication, vehicle assault and battery. |

Cottage Grove, Mn | First; let me offer my deepest condolences to the family of Mr. Craig Toner.
His death is a tragedy that was most certainly avoidable. This is a travesty of justice pure and simple. It was the judicial system that failed Mr. Toner and caused his death, the very system that he swore an oath to uphold. There is no way that idiot Orta should be breathing free air let alone be allowed to operate a motor vehicle. The courts just kept turning him loose and allowing him to continue his unacceptable behavior until the ultimate price was paid, but regrettably not by him. I apologize: I know this site is for topics of discussions about Victory Vision's but when incidents like this happen I just lose control. Again I apologize. |

San Antonio, TX | We all ride or want to ride if we are on this forum. Each story I read like this I try to stow away and look for this type of behavior in traffic when I ride. Maybe, just maybe if I can recognize this type of behavior at the right time, this story could save my life.
Drivers that can cross my lane or into my lane are all out to kill me. Stay alert! Make it home safe.

As for Alexander Orta, in the late 1800's in San Antonio a repeat offender thumbed his nose at the legal system and threatened everyone's life in a court room. The jury then found him innocent of the crime and told him that he was free to go. A mob had gathered outside the court house waiting for this man. The mob took this man to the nearest oak tree and hung him. Later that night the mob added three others to the tree. The crime rate in San Antonio dropped over night and many other bad guys left town.
Maybe those that provide cocaine to Mr. Orta should hang beside him.
I am sure it would help the crime rate in the area and maybe save another rider. |

Now that's what I call justice! I knew I loved Texas for a reason. Although I'm not a native Texan I'm about to purchase the bumper sticker that says, "I wasn't born in Texas, but I got here as fast as I could."
